Terms of Service

Agreement

By accessing Anywhere Prototype v1 (the "Prototype"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Prototype.

Who you are contracting with

Anywhere (the product) is operated by Anywhere Inc., a Delaware corporation (file number 10770478; formation effective September 15, 2026). In these Terms, "Anywhere" means Anywhere Inc. Registered agent: Corporation Service Company, 251 Little Falls Drive, Wilmington, DE 19808. Mailing address: 169 Madison Ave, STE 81033, New York, NY 10016.

Every provision of these Terms that disclaims warranties, limits liability, or provides indemnification applies to and may be enforced by Anywhere Inc. and its founder, and their respective successors, assigns, affiliates, officers, agents, and service providers — each an intended beneficiary of those protections.

The service

Anywhere Prototype v1 is an invite-only, pre-release browser application for evaluating geospatial queries over US NAIP aerial imagery. The Prototype may change, break, or be discontinued without notice. It is not a production service and does not include service-level commitments. The Prototype is provided free of charge; Anywhere may introduce fees for future or successor products, but will not begin charging you for your current access without advance notice and your agreement.

Eligibility

Access is limited to individuals invited by the Anywhere team. You must be at least 18 years old (or the age of majority where you live). If you accept on behalf of an organization, you represent that you have authority to bind that organization.

Confidentiality

The Prototype is confidential pre-release material. That includes its URLs, access credentials and API keys, the documentation, the API contract and specification, the SDK, CLI, and MCP packages and their install index, API responses, pricing and Usage Credits terms, and unreleased features. You agree not to share any of it publicly or with unauthorized third parties, including screenshots, request and response traces, and copies of the documentation or packages.

Acceptable use

You agree to use the Prototype only for good-faith evaluation and feedback. You will not:

  • Submit boundaries or questions you are not authorized to analyze
  • Share credentials or enable unauthorized access
  • Scrape, overload, or automate abuse of the Prototype or underlying infrastructure
  • Reverse engineer models, prompts, or non-public systems beyond ordinary evaluation use
  • Use the Prototype for unlawful, harmful, or deceptive purposes
  • Use the Prototype in violation of U.S. export-control or sanctions laws, or access it from a country or as a person subject to U.S. sanctions

Your content

You retain ownership of content you submit (questions, boundaries, feedback). You grant Anywhere a limited, non-exclusive license to process that content solely to operate, secure, and improve the Prototype. You represent that you have the rights needed to submit your content.

Anywhere stores and may review the content you submit and the outputs you receive as described in the Privacy Policy, including for the retention periods stated there.

Our intellectual property

Anywhere owns and retains all right, title, and interest in and to the Prototype, including its software, models, prompts, user interface, documentation, look and feel, and the "Anywhere" and "Project Anywhere" names and logos. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Prototype solely for the good-faith evaluation purposes described in these Terms and only while you are an invited participant. No other rights are granted by implication or otherwise. You may not copy, modify, distribute, sell, license, publicly display, or create derivative works from the Prototype or any part of it, except as expressly permitted here.

Feedback

Feedback, suggestions, or ideas you provide may be used by Anywhere to improve its products and services without obligation or compensation to you.

Disclaimers

THE PROTOTYPE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Anywhere does not warrant that answers will be accurate, complete, or fit for any particular purpose.

Answers are best-effort interpretations of aerial imagery and models. Do not rely on the Prototype for legal, regulatory, safety-critical, financial, or operational decisions without independent verification.

Answers are generated by automated AI systems and may be incomplete, inaccurate, or wrong. They are estimates produced for evaluation only — they are not a land survey, boundary or property-line determination, appraisal, title, zoning, or environmental record, or any official, legal, or authoritative determination about any location or property. Do not use answers as a substitute for professional, licensed, or governmental sources.

Third-party data and services

The Prototype relies on third-party data and services, including US NAIP aerial imagery accessed through Microsoft Planetary Computer and AI inference provided through Google Cloud (Vertex AI). That data and those services are provided by third parties, and Anywhere does not control and is not responsible for their accuracy, completeness, currency, or availability; imagery in particular may be outdated, low-resolution, or incorrect. Your use of the Prototype may also be subject to the applicable terms of these third-party providers, and you agree not to use the Prototype in any manner that would violate those terms.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYWHERE AND ITS FOUNDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PROTOTYPE.

ANYWHERE'S AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE PROTOTYPE WILL NOT EXCEED THE AMOUNTS YOU PAID TO ANYWHERE FOR ACCESS (WHICH, FOR THIS FREE PROTOTYPE, IS ZERO).

Indemnification

You will indemnify and hold harmless Anywhere and its founder from any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Prototype; (b) the questions, areas of interest, or other content you submit, including any claim that you were not authorized to analyze a location or that your content infringes or violates the rights of a third party; or (c) your breach of these Terms or violation of applicable law.

Termination

Anywhere may suspend or revoke access at any time, with or without cause. You agree to stop using the Prototype when access ends or when requested. Sections that by nature should survive (confidentiality, disclaimers, limitation of liability, and indemnification) will survive termination.

Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You and Anywhere agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Prototype will be brought exclusively in the state or federal courts located in New York County, New York. You and Anywhere each consent to the personal jurisdiction and venue of those courts and waive any objection to them on grounds of forum or convenience. Either party may seek injunctive or other equitable relief in those courts to protect its confidential information or intellectual property, and either party may bring an individual claim in small-claims court if it qualifies.

General

If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Anywhere regarding the Prototype and supersede any prior agreements on that subject. Anywhere is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, outages or failures of third-party services or infrastructure, network or power failures, governmental actions, or labor disturbances.

Changes

We may update these Terms from time to time. When we do, we will post the revised Terms and update the effective date. Continued use after a material change requires re-acceptance at sign-in.
